The new recommendation of Justice B R Gavai, judge of the Bombay High Court, if cleared by the Centre, assumes significance as he will be in line to be sworn in as CJI on May 13, 2025, almost 15 years after Justice K G Balakrishnan demitted office as India’s first Dalit CJI. If the four judges are elevated, the Supreme Court will reach its full sanctioned strength of 31 judges after several years. Presently the court , is functioning with 27 judges. Earlier this week, the Centre has rejected the collegium’s recommendation to elevate Justices Aniruddha Bose and A S Bopanna to the apex court. In the latest resolution, the collegium has reiterated its decision and stated that nothing adverse has been found regarding their competence, conduct or integrity. The government had returned recommendation of the two judges citing seniority and representation of regions as the reasons. While Justice Bose whose parent high court is Calcutta, is at number 12 in the allIndia seniority of judges, Justice Bopanna, whose parent high court is Karnataka and is currently Gauhati HC Chief Surya Kanth BR Gavai SC TO HEAR AYODHYA CASE TODAY On Friday, all eyes will be on the SC, when the five-judge Constitution bench will hear the Ayodhya land dispute case after a mediation committee submitted its interim report in a sealed cover. Justice, stands at number 36. The gover nment had returned Justice Bose’s name to the collegium last year too when he was recommended to head the Delhi high court. The collegium has also recommended the name of Justice Surya Kant, Chief Justice of the Himachal Pradesh HC, for elevation to the apex court. He too will be in line to become CJI after Justice Gavai, if elevated now. Justice Gavai had gone on record to contradict the allegations of foul play made by the family of CBI judge B H Loya, who reportedly died of a heart attack while attending a wedding in Nagpur in 2014. By recommending Gavai, the collegium acknowledged that his seniority stands at No. 8 among India’s high court judges, but pointed out that India’s top court has not had a Dalit judge in a decade.
