The UP police had issued notice to him to appear before them in connection with a doctored video uploaded on Twitter, allegedly to disturb communal harmony . Disposing of the petition filed by Manish Maheshwari, Justice G Narendar said that provisions of the statute cannot be allowed to become tools of harassment. The UP police had not placed any material to prima facie demonstrate the involvement of the petitioner. The petitioner made out a case that he is not an accused and the notice issued to him is malafide. Hence, the notice is quashed, the judge said. However, the court said that the statement of the petitioner, as a witness, can be recorded virtually or UP police can meet the petitioner in Bengaluru if the investigators desire to do so, treating the notice under question as issued P7 under Sec 160 of CrPC.
