At least 200 MPs from several Opposition parties took part in the march, which started from Parliament House. They were stopped at Vijay Chowk, following which the members called off the march and returned to Parliament. Leader of Opposition in the Ra- jya Sabha Mallikarjuna Kharge, who led the march, said the government is trying to suppress the voice of the Opposition inside and outside Parliament. “They have deployed over 2,000 police personnel and we are only 200 people. The position has been vacant ever since Kenneth Juster stepped down as the US envoy in India in January 2021 after the Biden administration entered White House. Last week, the Senate Foreign Relations Committee had voted 13-8 in favour of Garcetti’s nomination. The process initiated by Senate Majority leader Chuck Schumer in the 100-member House came amidst a fresh round of campaign against Garcetti, who is facing charges of inaction in a case of sexual assault by one of his staffers when he was the mayor of Los Angeles. For his part, Garcetti has maintained that he was unaware of the misdemeanor. However, a Senate report had suggested that Garcetti had ignored a pattern of alleged sexual harassment by his then aide. Garcetti’s nomination was pending before the US Congress since July 2021, when he was first nominated by President Joe Biden. Biden renominated him for the post in January last. During his confirmation hearing at the Senate foreign relations committee meeting in December 2021, he had said the human rights situation in India would be a core piece of his diplomatic engagement, adding he intended to engage with the country’s civil society directly . A division bench of Chief Justice S Muralidhar and Justice M S Raman on Wednesday made the stinging observation while admitting that the legal system had completely failed in the case of Pidera Kadaiska from the Kandha tribe, a particularly vulnerable tribal group (PVTG), who died in police custody 13 years ago. The bench stated, “Although there have been numerous instances of custodial deaths which have been dealt with by this court from time to time, it is as if those judgements have not persuaded the police to change their habits.” The court directed payment of `10 lakh compensation in the case to the victim’s wife Maria Kadaisma, who had approached the high court in 2010 seeking justice. Orally observing it would be a sad spectacle for democracy, Chief Justice of India D Y Chandrachud said, “The only thing is that a resolution of 34 MLAs which said that there was widespread discontent among the party cadres and legislators....Is this sufficient ground to call a trust vote?” The governor, he said, cannot enter a domain that would precipitate the matter. “People will start ditching the ruling party and governors being willing allies would end up toppling the ruling party This will be a sad . spectacle for democracy .” Trust vote, he said, is to establish who is the leader of the House and not who is the leader of a party Referring to allega. tions that the rebel MLAs were facing threats to their life and property the CJI said the proc, ess is to lodge FIRs, not bring down a government. The CJI said the governor could not assume to himself judicial power and come to the conclusion that the 34 MLAs would have to be excluded from consideration because they had incurred a disqualification under the tenth schedule. Senior advocate Kapil Sibal, appearing for the Thackeray faction, said: “We’re back to ‘Aaya Ram, Gaya Ram’.” Bhagat Singh Koshyari Use powers judiciously, says CJI “The governor must be conscious of the fact that his calling for a trust vote may itself be a circumstance which may lead to toppling of a government...
