HC: No criminal case against teacher for beating student if intention is to guide E xpress N ews S ervice @Kochi The Kerala High Court has ruled that a criminal case will not stand against a teacher for beating a student if the intention is to guide the individual towards academic improvement. Justice A Badharudeen issued the order in response to a petition filed by Jomi, an English teacher and the principal of St Joseph School, Thottuva, seeking to dismiss the case. The teacher was accused of beating a 13-year-old Class VIII girl after she failed to secure fair marks on a test paper. The court pointed out that despite the allegation of physical punishment, no serious injuries were sustained. “The teacher had no malafide intention while beating the student or his intention was to guide her by alerting her to the necessity of studying well and securing high marks in the subject” stated the court order. The Kodanad police had filed a case against the teacher under Section 324 of the IPC and Section 82 of the Juvenile Justice Act. The petitioner argued that the act of disciplining the student, done within the implied authority given by the parents and with genuine intent to guide the student, should not be considered an offence under Section 75 of the Ju● More on P4 venile Justice Act. Six arrested over Hathras mishap N A M I TA B A J PA I @ Lucknow THE Uttar Pradesh police on Thursday said they have arrested six sevadars (volunteers) of preacher Bhole Baba alias Narayan Sakar Hari alias Suraj Pal Jatav, in connection with the stampede at a prayer meet at Hathras that killed 121 people on Tuesday “Four men and two women . have been arrested in connection with the unfortunate incident. They are all members of the organising committee and worked as sevadars,” IG Aligarh range Shalabh Mathur said during a press meeting. The officer said the arrested persons were responsible for crowd management. “They used to manage the crowd control independently and would not allow the administration to tackle the situation,” he added. The arrested persons are Ram Ladaite Yadav, Upendra Yadav, Megh Singh, Manju Yadav, Manju Devi, and Mukesh Kumar. However, the main accused in the FIR, mukhya sevadar (chief volunteer) Dev Prakash Madhukar — an engineer with UP Panchayati Raj department — is still at large. Police have announced `1 lakh reward for information about him. Sources said his residence in Hathras is locked and his family members, too, are untraceable. While the FIR doesn’t name the baba, sources said police have raided his eight suspected hideouts in Mainpuri, Gwalior, Kanpur, and Hathras, but to no avail.
