The CBI had arrested Kejriwal on June 26 in connection with a corruption case linked to the nowscrapped Delhi excise policy and was placed under judicial custody; on Friday a trial court extended , the judicial custody till July 25. Kejriwal, lodged in Tihar Jail, was produced through video conferencing before Special Judge Kaveri Baweja. While granting interim bail to Kejriwal, the SC bench comprising justices Sanjiv Khanna and Dipankar Datta made some sharp remarks about the manner in which the ED makes its arrests. The bench said if there is wrong application of law, courts can strike down the agency’s decision and such an action will be deemed review of errors of law. “This would not amount to judicial overreach or interference with the investigation,” it clarified. The bench further observed that the “undue indulgence and latitude to the ED will be deleterious to the constitutional values of rule of law and life and liberty of people”, adding that the power to arrest must be exercised in a fair manner. “An officer cannot selectively pick and choose material implicating the person to be arrested,” it said, adding the sleuths can’t refuse to consider any material that exonerates the arrestee. The bench referred Kejriwal’s petition challenging his arrest and remand by the ED in the excise policy case to a larger bench, saying the legal questions regarding the “necessity to arrest” under Section 19 of the Prevention of Money Laundering Act raised in the plea need in-depth perusal. Another person was injured in the incident. Elaborating on the issue, police said the deceased women, identified as Gundamma (50), was having disputes with another family over a piece of farm land for the past one year. A native of Naganathahalli village, Gundamma, a widow, had purchased four acres of agricultural land in the village from a n o t h e r w o m a n , Tirupatamma. Differences b e t w e e n Gundamma Tirupatamma’s family and their relatives surfaced over the sale of the land. Tirupatamma’s close relative Raghavendra Reddy and his family members had been claiming rights over the fouracre land and objected to Gundamma purchasing it. The delay in tracing the minor has been attributed to the inconsistent statements given by the accused to the police. The incident took place on Sunday, but came to light on Wednesday, following which a search operation was launched. As part of the investigation, the three accused were brought to the crime scene at Muchumarri lift irrigation pump house on Friday. The accused reportedly showed two places, from where they claimed they had pushed the body into the water. Additionally, they also informed the investigators that they buried the body in the village burial ground. Police pressed an excavator to retrieve the body but in vain. , Kurnool Range DIG Ch Vijaya Rao on Friday visited the spot and took stock of the situation.
