While the CJI and Justices Surya Kant, M M Sundresh, and Manoj Misra upheld the constitutional validity of Section 6A, Justice J B Pardiwala dissented and quashed Section 6A prospectively . The majority verdict held that Section 6A was enacted to balance the humanitarian concerns with the need to protect the local population.
