P5 The Supreme Court on Monday dismissed pleas challenging the 1976 amendment to the Constitution to add the terms ‘socialist’, ‘secular’ and ‘integrity’ to its Preamble, saying Parliament’s amending power extended to the Preamble as well. “Neither the Constitution nor the Preamble mandates a specific economic policy or structure, whether left or right. Rather, ‘socialist’ denotes the state’s commitment to be a welfare state and its commitment to ensuring equality of opportunity ,’ the verdict authored by Chief Justice Sanjiv Khanna said. Wondering why the challenge was made after over 44 years, the court said terms like socialist and secular were integral to the Preamble. In essence, the concept of secularism represents one of the facets of the right to equality woven into the ba, sic fabric that depicts the constitutional scheme, the sevenpage judgment said. The fact that the Constitution was enforced in 1949 does not make any difference. The date of adoption will not curtail or restrict the power of Parliament to amend under Article 368 of the Constitution. “The retrospectivity argument, if accepted, would equally apply to amendments made to any part of the Constitution,” the verdict emphasised. “While it is true that the Constituent Assembly had not agreed to include the words ‘socialist’ and ‘secular’ in the Preamble, the Constitution is a living document... with power to amend,” it said.
