The governor has no option but to give assent to the bill that is presented to him after re-passage in the state assembly if it is unchanged, a two-judge bench comprising justices J B Pardiwala and R Mahadevan said. The court said the governor must act on the aid and advice of the state legislature. “Under Article 200 of the Constitution, the governor does not possess any discretion and has to mandatorily act on the aid and advice of the council of ministers.” Article 200 of the Constitution deals with assent to bills. The bench said once the governor withholds assent, he is obligated to follow the procedure prescribed in the first proviso of Article 200, which is on returning the bill to the House as soon as possible. It exercised its special power under Article 142 to make the bills re-presented to the governor, as deemed to have been passed. A final causelist is yet to be uploaded on the court website. The Centre on Tuesday filed a caveat in the Supreme Court and sought a hearing before any order was passed in the matter. A caveat is filed by a party in courts to ensure that no orders are passed without hearing it. Former Additional Solicitor General (ASG) and senior Supreme Court lawyer, K C Kaushik, speaking to this newspaper, said the Centre wanted a representation before any order is passed by the SC. “No ex-parte order should be issued without prior notice and an opportunity to be heard. The government wants to be the prime respondent in the matter,” he said. The study, jointly by Wildlife Institute of India (WII), Dehradun and the Center for Cellular and Molecular Biology (CCMB), Hyderabad, was published in a report ‘Monitoring Sea Turtles in India 2008- 2024’ by the Indian Institute of Science (IISc) and Dakhin Foundation of Bengaluru. Scientists of WII and CCMB ex- amined the molecular genetics of sea turtles along the mainland coast and islands of India. It suggested the Indian Olive Ridley sea turtles and Kemp’s Ridley sea turtles could be remnants of a global population which was otherwise extirpated following climatic changes before and after the closure of the Isthmus of Panama. The Indian Ocean region, thus, may have served as a source for Ridley re-colonisation following the extirpation of populations in other ocean basins. Long-term monitoring of nesting and foraging populations is vital to detect biologically significant trends and patter ns for species like sea turtles. The Dakhin Foundation, in collaboration with IISc and Forest department, initiated research and monitoring in the late 2000s for Olive Ridley sea turtles in Odisha and leatherback turtles in the Andaman and Nicobar Islands. Amit Malviya, head of BJP’s IT cell, shared the screenshots, indicating a bitter argument between TMC MPs Kalyan Banerjee, Kirti Azad and Mauha Moitra. The authenticity of the screenshots couldn’t be independently verified. But this newspaper spoke to many senior leader of the TMC and none of them refuted the incident though they didn’t divulge any detail. Banerjee, speaking to reporters in Kolkata, acknowledged the altercation but blamed the ‘woman MP’ involved. “I’ve been in politics for 40 years. This woman MP asked the security at the EC office to arrest me. She hurled abuses at me. It’s me who fights in Parliament, not someone obsessed with a particular industrial house,” alleged Banerjee, the party’s chief whip in the Lok Sabha.
