General secretary of the CPI-Maoist, he carried a reward of `1 crore on his head in Chhattisgarh. He was also a Politburo member and headed the CPI’s Central Military Commission. Waqf means charity which is part of every , religion, and waqf bodies discharge secular functions. Therefore, it is necessary to include non-Muslims in waqf boards, Solicitor General Tushar Mehta said in his arguments defending the Waqf (Amendment) Act. “Waqf is an Islamic concept. But it is not an essential part of Islam, unless that is shown. Other arguments fail. The judgments show that charity is part of every religion and can hap- pen for Christianity also. Hindus have a system of daan. Sikhs also have it,” Mehta told a bench of Chief Justice B R Gavai and Justice Augustine George Masih in response to a question whether the law infringed upon Articles 25 and 26 (freedom of religion and management of religious affairs) of the Constitution. He said ‘waqf by user’ is not a fundamental right but was created by a statute. If a right is conferred by statute, the right can always be taken away by a statute, he added. The law officer also drew the bench’s attention to the “historic misuse” of waqf by user to claim ownership of public or p r ivat e l a n d s w i t h o u t documentation. Mehta sought to distinguish between waqf and Hindu trusts and endowment boards that don’t allow non-Hindus to be members. Although the state gover nment had earlier assured that it would bankroll the scheme entirely from its own resources until the centre releases funds, the silence on admissions under the RTE Act for the upcoming 2025-26 academic year, commencing in less than two weeks, has raised doubts. The notification for admissions to Class 1 under the RTE Act for 25% of the seats, which all private state board schools are mandated to reserve for children from economically weaker sections, is usually issued by the gover nment in midApril. In its suit filed in the apex court, the state government said the union government should be directed to pay `2,291.30 crore within a timeframe to be fixed by the court with an interest rate in the future of 6% per annum on the principal sum of `2,151.59 crore (which the centre should have released for 2024-25), from May 1, 2025, until realisation of the court’s decree. The reason for this non-disbursement, cited in the TN government’s petition, is that the central government has linked the release of the SS funds with the implementation of a different centrally-sponsored scheme — PM SHRI, which aims to establish model schools in states, showcasing the implementation of the National Education Policy (NEP) 2020, including the three-language formula that the state government is vehemently opposed to. The petition filed by the state also sought the apex court to declare the union government’s linking of Tamil Nadu’s entitlement to funds under the SS scheme to the implementation of NEP 2020 and PM SHRI, as “unconstitutional, illegal, arbitrary and unreasonable”.
